POLLUTION CONTROL CERTIFICATE
All new intending developmental and industrial projects that are likely to emit any harmful substance into the environment which may involve the discharge of sewerage or hazardous waste and lead to any form of pollution should mandatorily obtain “Consent to Establish” or NOC from State Pollution Control Board as per the provision of Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981.
The industries are categorized as red, orange, green, white, and exempted based on the hazard and pollution potential of their industrial activities. There are various restrictions for industries under the red and orange category which all prospective entrepreneurs should be aware of when selecting land for their proposed industries.
The entrepreneurs need to apply online for obtaining NOC from the West Bengal Pollution Control Board (WBPCB). You should apply for the certificate before setting up the industry. For units starting operations after obtaining Consent to Establish certificate issued by the Board or already running units, you have to apply for ‘Consent to Operate’ certificate under the Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981.
The Consent to Establish and Consent to Operate certificates are issued for a maximum of 5 years for industries under Orange category and a maximum of 10 years for industries under the Green category. After the valid duration, the certificates will have to be renewed. In the case of an industry undergoing any upgradation, change or expansion, it is necessary to obtain a fresh NOC from WBPCB.
Documents required for the online application for Consent to Establish Certificate:
Any land related documents such as a land deed, lease document, rent agreement, rent receipt, or porcha as applicable.
The 3rd copy of the paid bank challan as evidence for depositing fees.
Self-certified layout or site plan with route map or road map.
Self-certified undertaking Gross Capital Investment Certificate.
Project Report with details of emission, list of machinery, raw materials, finished products, solid waste management plan, manufacturing process, effluent, etc.
Documents required for the online application for Consent to Operate Certificate:
The following documents are necessary for obtaining Consent to Operate along with all the other documents that are required for Consent to Establish certificate.
Affidavit in Fixed Assets or Certificate by a C.A.
Flow chart for the manufacturing process.
Analysis report of laboratory for emission details.
Copy of Consent to Establish (NOC) Certificate
Test reports for emission or effluent done within the last one year.
Steps involved in the procedure for obtaining Consent to Establish and Consent to Operate:
The prescribed online application form has to be duly filled up and uploaded on the official site of the West Bengal Pollution Control Board (https://wbocmms.nic.in/).
The necessary documents have to be uploaded on the site as mentioned along with the prescribed fee.
The authorized officer then delegates and assigns the application to a Field Officer who will review the application and visits the industry.
A visit report is prepared and submitted by the Field Officer to the Sub-Regional Officer.
The application is approved once the documents and other aspects are verified and scrutinized.
